This Indenture made the first day of April One thousand Nine hundred and Twenty One between Thomas Henry Lush of Braishfield in the County of Southampton Gentleman of the first part The Right Honorable William St John Fremantle Earl Midleton of “Peper Harow” Godalming in the County of Surrey The Right Honorable Henry Baron Ashcombe of “Denbies” Dorking in the said County of Surrey William Henry Myers of Swanmore House Bishops Waltham in the County of Southampton Esquire Sir William Wyndham Portal of Haverstoke House Whitchurch in the said County of Southampton Baronet The Right Reverend John Hugh Granville Lord Bishop of Guildford of Wonersh Surrey William Graham Nicholson of Basing Park Alton Hants Esquire M.P.

Shawford Hants Esquire the present Trustees of The Winchester Diocesan Trust Deed 1898 (hereinafter called “the Diocesan Trustees” which expression is hereinafter intended to include the Trustees for the time being of that Deed) of the second part and The Reverend Edward Ralph Chamney Vicar of Braishfield in the County of Southampton Clerk in Holy Orders and the said Thomas Henry Lush and Edwin James Lovelace of Crook Hill Farm near Romsey in the County of Southampton the present Churchwardens of Braishfield (hereinafter called “the Administrative Trustees” which expression is hereinafter intended to include the persons for the time being holding the Office of Administrative Trustees of these presents) of the third part Whereas these presents are supplemental to The Winchester Diocesan Trust Deed 1898 (hereinafter called “the Principal Trust Deed”) And whereas the said Thomas Henry Lush is seised of the hereditaments hereinafter described and intended to be hereby conveyed for an estate of inheritance in fee simple in possession free from incumbrances and is desirous of conveying the same to the user and upon the trusts hereinafter declared or referred to Now this Indenture witnesseth that in order to carry into effect the said desire he the said Thomas Henry Lush doth hereby convey unto the Diocesan Trustees All that triangular piece or parcel of land situate at Braishfield in the Parish of Michelmersh in the County of Southampton with a width at the rear thereof of Thirty Seven feet or thereabouts and a depth of Seventeen feet or thereabouts and more particularly delineated and colored pink on the plan drawn hereon To hold the same unto and to the use of the Diocesan Trustees in fee simple Upon Trust to permit the said piece of land to be used as a site for a memorial to be erected thereon as a memorial to those Parishioners of Braishfield aforesaid who have fallen either on sea or land during the Great European War of 1914 to 1918 And it is hereby agreed and declared that the said premises and the said memorial shall be in all respects under the management and control of the Administrative Trustees And it is hereby agreed and declared that when and so soon as the said Edward Ralph Chamney shall cease to be Vicar of Braishfield aforesaid and so soon as either of them the said Thomas Henry Lush and Edwin James Lovelace shall cease to hold the Office of Churchwardens of Braishfield aforesaid the said Edward Ralph Chamney, Thomas Henry Lush and Edwin James Lovelace as the case may be shall ipso facto cease to be one of the Administrative Trustees hereof and the Diocesan Trustees shall forthwith proceed to appoint in the room of the said Edward Ralph Chamney his successor as such Vicar as aforesaid and in the room of the said Thomas Henry Lush and Edwin James Lovelace as the case may be such person or persons as may succeed him or them in the Office of Churchwarden of the Parish of Braishfield aforesaid to be an Administrative Trustee hereof And in like manner each such person shall on ceasing to be Vicar or Churchwarden as the case may be ipso facto cease to be an Administrative Trustee hereof and the Diocesan Trustees shall forthwith proceed to appoint another person who shall be qualified by being the Vicar or by holding the Office of Churchwarden of the said Parish as the case may be it being the intention of these presents that the Vicar and Churchwardens for the time being of the Parish of Braishfield aforesaid shall be Administrative Trustees hereof and pending this formal appointment each such succeeding Vicar or Churchwarden as the case may be act as an Administrative Trustee hereofAnd it is hereby agreed and declared that these presents are registered in the books of the Diocesan Trustees under the sign and number “A No. 170” and may be referred to in any instrument as “The Braishfield War Memorial Trust Deed” and that any two of the Diocesan Trustees shall have the power of appointing new Administrative Trustees of these presents in pursuance of a Resolution of the Diocesan Trustees or of a Committee thereof appointed for that purpose and that such appointment may be in the form set out in the Schedule hereto and that the signatures of any two of the Diocesan Trustees to any such appointment shall be conclusive evidence that such appointment has been duly made in pursuance of such resolution aforesaid And that nothing in these presents contained shall render the Diocesan Trustees or any of them personally liable to account for any income of the said trust premises or for the proceeds arising from any sale or mortgage thereof And it is hereby agreed and declared that all the provisions of the Principal Trust Deed applicable to property vested in the Diocesan Trustees for special purposes shall apply to these presents In Witness whereof the said parties to these presents have hereunto set their hands and seals the day and year first above written
The Schedule above referred to.
We the undersigned being two of the Trustees of the Winchester Diocesan Trust Deed 1898 do hereby on behalf of all the Trustees of that Deed appoint —— of —– and —— of —— to be Administrative Trustees of the “Braishfield War Memorial Trust Deed” to act with (remaining Administrative Trustees) in the place of (deceased or retiring Administrative Trustees).
